1. Acceptance of these terms
These Terms & Conditions ("Terms") govern all transport, courier, freight forwarding, warehousing and customs brokerage services provided by SwiftCare Transport ("SwiftCare", "we", "us"), and your use of this website. By booking a shipment, handing goods to our couriers, creating an account or using the tracking service, you accept these Terms on behalf of yourself and anyone with an interest in the shipment.
If you are booking on behalf of a company, you confirm that you have authority to bind that company to these Terms. Where you and SwiftCare have signed a separate written contract, that contract prevails over these Terms wherever the two conflict.
2. Our services
We provide door-to-door and port-to-port movement of documents, parcels, pallets and containerised cargo using road, air, sea and rail transport, together with related warehousing, consolidation and customs brokerage. We may perform any part of a service ourselves or through carefully selected subcontractors, agents and carriers, and we remain responsible to you for the service as a whole.
We may choose the route, the means of transport and the sequence of stops, and may change them where operationally necessary, provided we still work towards the agreed delivery commitment.
3. Quotations, charges and payment
- Quotations are based on the information you provide about weight, dimensions, contents, value and addresses, and are valid for 14 days unless stated otherwise.
- We may re-weigh and re-measure any shipment. Where the actual weight or volumetric weight exceeds what was declared, charges are adjusted accordingly and the difference becomes payable.
- Additional charges may apply for waiting time, failed collection or delivery attempts, address correction, redelivery, storage beyond free days, remote-area surcharges, fuel surcharges and special handling.
- Unless you hold an approved credit account, charges are payable in advance. Credit account invoices are payable within 30 days of the invoice date.
- Overdue amounts may attract interest at 1.5% per month or the maximum permitted by applicable law, whichever is lower, plus reasonable recovery costs.
- We may exercise a general and particular lien over goods in our possession for any sums owed to us.
4. Your account
Creating an account is free. You are responsible for keeping your password confidential and for all activity under your account. Tell us immediately if you believe your account has been accessed without your permission.
Shipments are linked to your account by email address: where the email you register with matches the sender or receiver email recorded on a shipment, that shipment and its full details become visible on your dashboard. You must only register email addresses you own and control. We may suspend or close accounts used to attempt access to shipments that do not belong to you, or otherwise used unlawfully.
You may close your account at any time by contacting us. Closing an account does not delete shipment records we are required to keep for customs, tax and liability purposes.
5. Packaging and labelling
You are responsible for packing goods so they withstand normal handling, stacking, vibration and changes in temperature and humidity across the whole route. Each item must carry a durable label showing the full sender and receiver details and the tracking number.
We may refuse or repack, at your cost, any item that is inadequately packed or whose packaging endangers other cargo, our people or our equipment.
6. Prohibited and restricted items
The following may not be shipped through our network without our prior written agreement and, where required, appropriate certification:
- Dangerous goods, explosives, flammable liquids and gases, corrosives, radioactive and toxic substances, unless booked as a declared dangerous-goods consignment with valid documentation.
- Currency, bearer instruments, precious metals, loose gemstones and unset jewellery.
- Illegal drugs, narcotics and items whose possession or movement breaches any applicable law or sanction.
- Live animals, human remains and body parts.
- Perishable goods, unless booked on a temperature-controlled service.
- Firearms, ammunition, weapons and their component parts.
- Counterfeit goods and items infringing third-party intellectual property rights.
You warrant that each shipment complies with all applicable export, import and sanctions laws. We may open, inspect, hold, return or lawfully dispose of any shipment we reasonably believe breaches this clause, and you indemnify us against any resulting loss, fine or penalty.
7. Collection, transit and delivery
Collection and delivery windows are estimates, not guarantees, unless you have purchased a service expressly sold as time-guaranteed. Our couriers may require identification and a signature on delivery. Where you have authorised it, we may leave a shipment in a safe place or with a neighbour, and that delivery counts as complete.
If delivery cannot be completed, we will attempt redelivery or hold the shipment at a local facility. Shipments uncollected after 20 calendar days may be returned at your cost or, after written notice, sold or disposed of to recover charges.
8. Tracking information
Tracking data, including the route stops, timestamps and estimated delivery dates shown on this website, is provided for convenience and reflects the information recorded by our operations teams and partner carriers. Estimated dates change as a shipment progresses and do not form a contractual delivery promise unless a guaranteed service was purchased.
Anyone holding a tracking number can view a limited summary of a shipment's route and status. Full contact and address details are shown only to signed-in account holders whose email matches the sender or receiver, and to our staff.
9. Customs, duties and taxes
You must provide complete and accurate customs documentation, including a truthful description of the goods, their value and their country of origin. Understating value or misdescribing contents is unlawful and may lead to seizure, fines and prosecution.
Unless the shipment was booked on a delivered-duty-paid basis, import duties, taxes and clearance charges are payable by the receiver before delivery. Where we advance such amounts on your behalf, they become immediately repayable to us together with an administration fee.
10. Liability and insurance
Our liability for loss of or damage to goods is limited to the lower of the declared value of the shipment and the limits set by any mandatory international convention applying to the transport leg concerned, including the Montreal Convention for air carriage, the CMR Convention for international road carriage and the Hague-Visby Rules for sea carriage.
Where no mandatory convention applies, our liability is limited to the declared value of the shipment, or where no value was declared, to USD 100 per shipment.
We are not liable in any circumstances for indirect or consequential loss, including loss of profit, loss of market, loss of contract or reputational damage, even where we were told such loss was possible.
Extended cover for high-value cargo is available if requested and paid for before collection.
11. Claims procedure
- Visible damage or shortage must be noted on the delivery record at the time of delivery and reported to us within 7 calendar days.
- Concealed damage must be reported within 7 calendar days of delivery, with photographs of the goods and the packaging.
- Loss or non-delivery must be reported within 30 calendar days of the date the shipment was handed to us.
- Claims must be submitted in writing with the tracking number, a description of the goods, evidence of value and evidence of loss.
- Claims are normally assessed within 14 business days of receiving complete documentation. All charges due to us must be paid before a claim is settled.
12. Delays and events beyond our control
We are not liable for delay or non-performance caused by events outside our reasonable control, including extreme weather, natural disasters, epidemics, war, civil unrest, terrorism, strikes and industrial action, port or airport congestion, cyber-attacks, government action, customs inspection and vehicle, vessel or aircraft breakdown.
13. Cancellation and refunds
You may cancel a booking free of charge before the shipment has been collected. Once collected, cancellation is treated as a return and return transport charges apply. Freight charges for shipments already in transit are not refundable, though we will always try to find the most economical way to bring goods back to you.
14. Acceptable use of this website
You agree not to use this website to attempt unauthorised access to shipments, accounts or systems, to submit false information, to send automated queries at a rate that burdens our infrastructure, to introduce malicious code, or to copy substantial parts of the site for commercial reuse. We may suspend access where we reasonably suspect misuse.
15. Intellectual property
All content on this website, including text, images, logos, layout and software, belongs to SwiftCare Transport or its licensors and is protected by copyright and trade mark law. You may view and print pages for your own use in connection with our services; any other reproduction requires our written permission.
16. Governing law and disputes
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules, and subject always to any mandatory international convention. Disputes are subject to the exclusive jurisdiction of the courts of Los Angeles County, California, except that we may bring proceedings for unpaid charges in the courts where you are located.
Nothing in these Terms limits any statutory right you may have as a consumer in your country of residence.
17. Changes to these terms
We may update these Terms from time to time. The version published on this page when your shipment is booked is the version that governs that shipment. Material changes affecting account holders are announced on this website at least 14 days before they take effect.
